Transit (Cross-Border Transport)

Transit refers to the transportation of goods through Thailand, from one customs checkpoint where the goods enter the country to another where they exit, under the supervision of customs authorities. Both the origin and the destination of the goods are located outside Thailand. During transit, goods may undergo changes such as vehicle transfers, repackaging, storage, or changes in the mode of transport to facilitate the journey. However, the goods must not be used, sold, or otherwise utilized for any commercial purpose while passing through Thailand.

There are two types of transit operations currently in practice:

  1. Transit Based on International Agreements

1.1 Road Transport Agreement between Thailand and Laos

  • Governed by the Agreement on Road Transport between the Kingdom of Thailand and the Lao People’s Democratic Republic.
  • The responsible party, referred to as a Transit Carrier, must be approved by the Department of Land Transport to conduct cross-border transit operations.
  • Transport must follow the agreed customs checkpoints for entry and exit, as well as specified transportation routes.

1.2 Transit Agreement between Thailand and Malaysia

  • Governed by the agreement for the transit of Malaysian goods via Thailand by rail.
  • The State Railway of Thailand serves as the authorized transit carrier.
  • This agreement primarily facilitates the transport of goods between Malaysia’s eastern and western coasts using Thailand’s rail network.
  • Responsible Customs Checkpoints:
    • Padang Besar Customs Checkpoint
    • Sungai Kolok Customs Checkpoint
  1. Transit Under the GATT 1994 Agreement
  • Governed by the General Agreement on Tariffs and Trade (GATT 1994).
  • The responsible party is referred to as a Transit Applicant.

Transshipment

Definition
Transshipment refers to the process of transferring goods from one vehicle arriving in the country to another vehicle that will transport them out of the country, within the same customs station or area, under the supervision of customs authorities. Both the origin and the final destination of the goods are located outside the country, and the goods are not utilized within the country during the process.

According to Customs Department Announcement No. 140/2560, electronic customs procedures for transshipment came into effect on November 13, 2017. The detailed procedures and conditions for transshipment are as follows:

Conditions for Transshipment

  1. Goods imported into the kingdom for transshipment must comply with the following conditions:
    • A shipping manifest or international transportation document must specify the origin and destination ports/airports outside the kingdom.
    • A Container List (if applicable) must specify the transshipment port/airport in the kingdom.
    • If the applicant is not the shipping line or airline representative, their name must appear on the shipping manifest.
    • Transshipment goods must be exported out of the kingdom within 30 days from the date of their entry.
    • If the applicant wishes to change the customs procedure from transshipment to import, they must amend the shipping manifest or international transport documents and submit import customs clearance, including duty payments (if applicable).
  2. Goods not exported within the specified 30 days will be forfeited to the state.

Procedures for Transshipment Goods by Vessel

  • Uncontainerized or Loose Cargo:
    • Must be stored separately in a designated warehouse under customs supervision.
    • A tally sheet must verify the quantity of goods, and discrepancies must be recorded. Damaged items can only be inspected in the presence of customs officers, shipping agents, and relevant parties.
  • Containerized Cargo:
    • Containers must have a separate manifest from general imports.
    • Seal numbers must be recorded for each container.
    • LCL (Less than Container Load): Goods must be stored separately in the warehouse without mixing with other imports.
    • FCL (Full Container Load): Containers must be kept appropriately isolated.

Procedures for Transshipment Goods by Air or Land

Goods transported by air or land must follow similar storage and handling procedures as those for sea freight.

Filing a Transshipment Declaration

  1. Each transshipment declaration is limited to goods transported by the same vessel and may include multiple international transport documents with the same destination.
  2. Applicants must submit the declaration electronically using the Customs Department’s system.

Important Notes

  • Goods must comply with customs requirements and relevant laws, including international shipping documents and manifests.
  • Failure to export goods within the specified timeframe will result in forfeiture to the state.
